Terms & Conditions of Our Services

General Terms | Wash, Dry, & Fold Service other than Student Plans | Student Laundry Plans

General Terms and Conditions

These General Terms and Conditions apply to all Wash Dry & Fold services (including without limitation Student Laundry Plans and consumer and commercial wash dry & fold services).  All of the terms and conditions in this document are collectively referred to as “these Terms and Conditions”.

Definitions: “We”, “us” and “our” mean Festiva Lancaster, Inc., t/d/b/a Festiva Laundry, and “You” and “your” means our customer (all regardless of whether the initial letter is capitalized). “Wash dry fold services” or “wash dry fold service” (regardless of whether any one or more initial letter is capitalized, and whether singular or plural) collectively mean any and all services whereby we do any part or all of the laundry work for a customer, including without limitation student plans, consumer wash dry fold services and commercial laundry services. “Drop off” is shorthand for the event by which you get your laundry to us, whether it is dropped off to us or we pick it up from you or otherwise. “Clothes” and “Laundry” are general terms referring to all types of items, including without limitation clothing, linens and specialty items.

(Please let us begin by recommending a few things for you to do, to make our service better for you:

  1. We ask that you check your pockets before bringing the laundry to us!
  2. We ask you bring your laundry to us in a bag, not in a basket.
  3. We also ask that if you have items at the end of their useful life, that you discard them rather than including them with your laundry.

Damaged/Missing Items: We don’t inventory or count your laundry items. Although our normal procedure is to check pockets before loading your wash into the washers, in no case are we responsible for loss of or damage to any items left in your laundry (for example but without limitation: money, jewelry or anything else). You agree not to leave those things in your laundry.

Refused Items:  We may refuse to clean any laundry item (but if we do clean it we’re not accepting liability that we have disclaimed).

Weight: For any laundry that is paid by weight, the applicable weight for payment is the weight at drop off. If we are not able to weigh at drop-off, we have the right to charge based on our estimate of drop-off weight based on weight at pickup or otherwise.

Items which you agree not to include with your Wash Dry Fold laundry:  You agree not to give us any of the following:

  1. “Hand wash only” items
  2. “Dry clean only” items
  3. Leather
  4. Stuffed Animals
  5. Damaged items
  6. Down comforters
  7. Pillows
  8. Cushions
  9. Dog beds

Special Requests:  Our wash dry fold services include your choice of (a) hypoallergenic or scented laundry products, and (b) dress clothes hung or folded.  We are sorry, but we do not accept any other special requests unless agreed upon by us as set forth in the “No Changes” paragraph below.

Pricing: While we are conscientious of the importance of price stability, we reserve the right to increase or otherwise change the price(s) our Wash Dry Fold services at any time.  The only exception is for Student Plans already under a signed contract, for the Plan contract term not to extend beyond the current school year.  No advance notice is required for increases or other changes in our price(s).

Stains: We do not guarantee the removal of stains.

Reasonable Efforts: In general legal terms, we will use “reasonable efforts” to clean your laundry well. We really care about your clothes, but you know that in rare instances things get lost or damaged…even when Mom does the wash! So we are not responsible for missing, damaged, discolored, or shrunk items, or for color bleed.

If something bad happens, we will try to work with you, because we care. To increase the likelihood of satisfaction if you do have a problem, all claims must be made (a) within 24 hours after picking up or receiving back your laundry, or (b) if you did not pick up or receive back your laundry, within 30 days after the due date of the applicable order. Ultimately, however, if something (whether one or more individual items or even your entire order) is lost or damaged in any way (regardless of type or value) we do not accept legal liability, as more fully set forth in the Warranties & Limitation of Liability paragraph below.

Unclaimed Laundry:  We reserve the right to discard unclaimed Wash Dry Fold laundry after 30 days after the due date of the applicable order.

Permission to Communicate: You recognize that we are entering into a business relationship. You hereby consents to us phoning, faxing, e-mailing, texting and using social media (whether or not any such number, address or media is solely yours or belongs in whole or part to a third party) to communicate with you about: (a) pick-up and delivery, (b) marketing and/or other business-related communications (including automated calls or texts) and (c) any and all other purposes related to our business relationship or permitted by law. You agree and understand that with texting, standard message and data rates may apply.

Warranties & Limitation of Liability: WE HAVE NOT MADE ANY (AND WE MAKE NO) REPRESENTATIONS OR WARRANTIES, DIRECT OR INDIRECT, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER. IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL OR EXEMPLARY DAMAGES RELATED TO THESE TERMS AND CONDITIONS OR ANY SERVICE PROVIDED TO YOU OR NOT PROVIDED TO YOU. THIS LIMITATION OF LIABILITY SHALL APPLY WHETHER ANY CLAIM IS BASED UPON BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, PRINCIPLES OF INDEMNITY OR CONTRIBUTION, THE FAILURE OF ANY LIMITED OR EXCLUSIVE REMEDY TO ACHIEVE ITS ESSENTIAL PURPOSE OR OTHERWISE.

Venue and Choice of Law: The relationship between you and us is governed by and shall be construed in accordance with the law of the Commonwealth of Pennsylvania without regard to its conflicts of law provisions. You and we consent and agree that any legal proceedings related to our relationship shall be brought and maintained in a court of competent jurisdiction located in or with express federal jurisdiction over Lancaster County, Pennsylvania, and you and we agree that jurisdiction and venue for any such proceedings shall rely exclusively within the courts of the Commonwealth of Pennsylvania, or the United States District Court for the Eastern or Middle District of the Commonwealth of Pennsylvania.

Attorney’s Fees: You agree that if we are sued pertaining to (a) any item(s) that is(are) missing, lost, discolored, shrunk. color bled or otherwise damaged, (b) any item(s) that you or someone else claim(s) or acknowledge(s) you did not own or have the right to deliver to us, (c) Our termination of wash dry fold services to You for any reason or no reason, or (d) Our increasing the price of Wash Dry Fold services, then to the extent permitted by law you will reimburse us for the cost of our reasonable attorneys fees. Furthermore, if we consult an attorney or collection agency for the collection of any sums due from You, You, whether or not proceedings are instituted, shall reimburse Us for the reasonable fees for legal counsel and court costs, if any, incurred by Us.

Paragraph Headings: The paragraph headings of these Terms and Conditions are only for convenience, and shall not be deemed to limit or define the contents of the paragraph.

Severability: If any provision of these Terms and Conditions or the application thereof to any person or circumstance is held invalid or unenforceable to any extent, the remainder of these Terms and Conditions and the application of that provision to other persons or circumstances is not affected thereby and that provision shall be enforced to the greatest extent permitted by law.

No Changes: No employee or agent of Festiva Laundry is authorized to change anything in these Terms and Conditions, except in an express written agreement signed by the President or Vice President of Festiva Lancaster, Inc. Any other attempted or purported change shall not be binding on Us.  For example but without limitation, You cannot impose your own terms and conditions upon Us by any means including without limitation by purported email confirmations.  Additional limitations on changes or additions to these Terms and Conditions are set forth below.

Entire Agreement: These Terms and Conditions constitute the entire agreement between the Parties with respect to this subject matter and supersede all previous or contemporaneous statements, representations, understandings, negotiations, discussions and writings between Us with respect to this subject matter and cannot be modified except by a written instrument that is actually signed by the President or Vice President of Festiva Lancaster, Inc.

Benefits of these Terms and Conditions: You acknowledge that were we unable to rely upon the benefits of these Terms and Conditions, that we would have to price our Wash Dry Fold services at significantly higher price points.

Student Laundry Plans

These Student Laundry Plans Terms and Conditions apply to our Student Laundry Plans. The General Terms and Conditions set forth above also apply.

Terms of Service: We offer you our services subject to your compliance with and acceptance of these Terms and Conditions. Your use of the Festiva Student Laundry Plan indicates your agreement to be bound by the Terms and Conditions contained herein and the General Terms and Conditions. Please read them carefully and if you do not so agree, please do not use our services. These Terms and Conditions are subject to change without notice at any time, at our sole discretion.

Payment: Payment for student laundry plans must be made at sign-up. If you sign up after the 2nd week of the semester, we will prorate (using our reasonable judgment in our sole discretion) that semester’s plan price. If at any time you wish to have us do more laundry than fits into your bag, feel free to bring it to the Laundromat. Our regular wash-dry-fold rates and payment polices will apply to the laundry that does not fit in your bag. If you have any unused weeks during the course of the semester, you may not carry them over and we will not reimburse you. We do not offer refunds for any reason. (Except under the termination paragraph below)

Ownership of Your Laundry: YOU AGREE THAT THE ONLY LAUNDRY YOU WILL EVER DELIVER TO US WILL BE ITEMS YOU OWN. YOU AGREE NOT TO EVER DELIVER SOMEONE ELSE’S LAUNDRY TO US!

Third Party Rights: A person (such as a parent) who purchases a Plan on behalf of a student shall have no third party beneficiary or other rights with respect to the Plan or the student’s laundry.

Assignment: You may not assign or “sublet” your Student Plan, or any of your rights under the Student Plan or at law or equity, to any other person or entity.

Termination of Student Laundry Plans: For any college or campus, we reserve the right to terminate Student Laundry Plans (and/or the pick-up and delivery element) before or during a semester, for any or no reason, even after payment has been received and service has been used. In that case, we will refund payments received on a prorata basis, using our reasonable judgment in our sole discretion, and you agree that such refund is your sole remedy in case of such termination.

Pick-up and Delivery on Campus: [We currently do not offer pick-up and delivery service for Student Plans.]  The following four (4) paragraphs apply when we do offer pick-up and delivery:

We pick-up and deliver, at the place (the “depot”) and during the times that we will notify you from time to time. If we need to miss a time, or change depot sites or times, we’ll notify you by a means deemed convenient by us. Schedules are subject to change at any time, especially at the beginning of the semester. We are not responsible for missed pick-ups or deliveries, regardless of the reason.

If you are unable to come to the depot for your clean laundry, don’t worry – we’ll keep bringing it to the depot for the next week or two during that semester. Thereafter, you authorize us to temporarily keep it for you elsewhere, or at our option, to deliver it to your address on file with us in which case you agree: (1) that it may be dropped off there without being signed for and without prior notice to you, (2) to be fully responsible for it after it has been delivered, and (3) to reimburse us for any delivery charges.

Please don’t ask us to make special pick-up or delivery arrangements for you. But if you do and we agree, any such arrangements and your laundry are at your sole risk and responsibility.

Our Laundromat is nearby at 701 Columbia Ave, and you’re welcome to bring your laundry directly there instead of waiting to drop it off at the depot. Also, if you want to pick it up from there instead of at the depot, just let us know. These kinds of arrangements can become confusing for us (and as such are at your sole risk), but we’ll try to work with you. In any case, though, if you drop off at the Laundromat, the laundry won’t be ready for you for at least 48 hours after we receive it.

Wash, Dry, Fold Service other than Student Plans

These Wash, Dry, Fold Terms and Conditions apply to all Wash Dry Fold services (including without limitation consumer and commercial services), except Student Plans. The General Terms and Conditions set forth above also apply.

We care about your laundry, and are happy to provide wash dry fold services to you!

These Terms and Conditions control our services.  We offer you our wash dry fold services subject to your compliance with and acceptance of the these Terms and Conditions. Your use of the wash dry fold services indicates your agreement to be bound by the Terms and Conditions contained herein and the General Terms and Conditions. Please read them carefully and if you do not so agree, please do not use our services. These Terms and Conditions are subject to change by us without notice at any time, at our sole discretion.  You cannot impose your own terms and conditions upon Us by any means including without limitation by purported email confirmations, and under no circumstances will We be bound by any terms and conditions in addition to or contrary to these Terms and Conditions unless We have expressly agreed to the contrary in written document that is actually signed by the President or Vice President of Festiva Lancaster, Inc.

Termination of Service:  While we love our customers and hope all our business relationships last forever, we reserve the right to terminate our business relationship with, and our services to, you at any time and for any reason or no reason.  We will give reasonable notice of termination, if the circumstances permit, but we are not obligated to give you such notice.  If we have your clothing in our possession at time of termination, we will make reasonable attempts to return it to you or permit you to pick it up from us.

Pick-up and Delivery:  If we agree to provide pick-up and/or delivery, we will attempt pick-up and deliver at the agreed upon and time(s).  But things don’t always work on schedule, and we are not responsible for late or missed pick-ups or deliveries, regardless of the reason.

If we agree to provide pick-up and/or delivery, you agree to provide us parking and access to your location which is nearby, convenient, prompt and free.  We try to be flexible, but reserve the right if we deem it prudent, to charge extra for inconvenience and/or to require you to deliver/pickup at Festiva instead.  Without limiting the generality of the previous sentence, in the event we are ticketed in our attempt to park in a convenient nearby space, you agree to reimburse us for the ticket costs as additional payment for wash dry fold services.

Any pricing we quote you is subject to adjustment for things like small orders, one-way trips, specialty items, etc.  As with all pricing, pick-up and delivery charges are subject to change without notice.

Payment: Payment is requested at drop off. Unless other arrangements have been agreed upon in writing, payment must always be made before the return of your laundry to you. If we invoice you, you agree to pay late fees and interest on unpaid balances at rates and amounts set forth from time to time in invoices and statements, together with attorneys fees as set forth above.  You agree we may charge a convenience fee for credit card payments.

Ownership of Your Laundry: You agree that the only laundry you will ever drop off to us will be items you own, or are authorized to drop off to us.

Assignment: You may not assign your rights under these Terms and Conditions, or at law or equity, to any other person or entity.
